Heard learned counsel for the applicants, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicants with the prayer to quash the impugned charge-sheet dated 04.03.2011 as well as entire proceeding of S.T. No. 1293 of 2018 (State Vs. Wazid and others) arising out of Case Crime No. 2157 of 2009, under Sections 269, 272, 273 IPC, P.S. Kotwali Nagar, District Muzaffar Nagar.
As per the allegations made in the FIR, it is alleged that the applicants are involved in preparation of adulterated ghee. The police after investigation submitted the charge-sheet against the applicants in the year 2011. Pursuant to which, applicants have not surrendered before the court below, therefore, bailable warrants were issued against them.
Learned counsel for the applicants has submitted that the interest of justice shall be served provided some protection is granted by this Court to enable the applicants to appear before the court below.
Considering the facts and circumstances of the case, it is provided that the applicants shall appear before the court concerned within 15 days from today and move an application for recall of bailable warrants, which shall be considered and disposed of expeditiously in accordance with law.
For a period of 15 days from today, the execution of bailable warrants issued against the applicants shall remain stayed.
In case of default, interim protection granted by this Court to the applicants shall stand automatically vacated and the court below shall be free to proceed against the applicants in accordance with law.
With the aforesaid directions, this application is finally disposed of.
