Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed to expedite the proceeding of Case No. 2036 of 2009(State of U.P. Vs. Hazi Naseer and others) arising out of Case Crime No. 46 of 2009, under Sections 323, 354, 504, 506 IPC, Police Station-Civil Lines, District-Aligarh pending in the Court of learned Chief Judicial Magistrate, Aligarh.
Learned counsel for the applicant submitted that no offence against the applicant is disclosed and the present prosecution has been instituted with a malafide intention for the purposes of harassment. The charge sheet was submitted by the police wayback in the year 2009 and the trial has yet not been completed.
Under the circumstances, I hereby direct the learned trial court to gear up the matter and make necessary endeavour to conclude the trial by 30.06.2019 positively.
With the aforesaid directions, this 482 Cr.P.C. application is finally disposed of.
