Learned counsel for the petitioner contends that impugned order vide which the petitioner has been transferred to a place, three hundred kilometres away, has been issued by Superintendent of Police, who has no jurisdiction or no authority to pass order for transfer of a Junior Engineer. Only the Chief Engineer could have issued such direction.

Sri Amit Singh Bhadauriya, Advocate, appearned for respondent no.2 states that powers have been delegated to Superintendent of Police.

Let counter affidavit be filed.

It is made clear that the petitioner may join at the place of posting, which, however, shall remain subject to final decision of this writ petition.
