Supplementary affidavit filed today is taken on record. Heard learned counsel for the petitioner.
Present writ petition has been filed seeking a direction to the Civil Judge (J.D.) Pharanda, Maharajganj to decide/conclude the trial of Original Suit No. 483 of 2003, Jota Devi Vs. Phekna Devi within a stipulated period.
In the facts and circumstances of the case, the present writ petition is finally disposed of with the direction to the Civil Judge (J.D.) Pharanda, Maharajganj to expedite the hearing of the aforesaid suit and decide the same on its own merit, in accordance with law, expeditiously provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present writ petition is finally disposed of.
