Petitioner is aggrieved by an order dated 29th August 2019, whereby he has been sent from one block to another block in the same district.
The order is assailed on the ground that persons with longer length of service in the respective block, have been retained and petitioner has been transferred.
Petition is opposed by learned Standing Counsel.
It is not in issue that petitioner holds a transferable post and transfer is an incidence of service. Petitioner is otherwise continuing for the last three years in the same block. In such circumstances, no interference with the order of transfer is, therefore, called for. Length of service in a block is not the only criteria for transferring an employee and the competent authority has to examine the requirement of an employee, keeping in view the administrative exigency. Neither any statutory rule is shown to be violated nor any malafide is alleged.
Writ petition lacks merit and is, accordingly, dismissed.
