Heard Sri Krishna Kumar Chaurasia, learned counsel for the petitioner and the learned Standing Counsel for the State.
Petitioner claims himself to be a licencee for storage and sale of sand for the period from 25.6.2018 to 24.6.2023. It is one of the condition of licence that for the transportation of sand, the same can be done only after Form-C is given to the petitioner.
It is submitted by learned counsel for the petitioner that in spite of licence having been granted to the petitioner after depositing requisite fee etc., Form-C is not being issued without assigning any reason, therefore, the petitioner is not able to transport the sand for sale.
Learned Standing Counsel was granted time to seek instruction in the matter, but no instruction has come so far.
In our considered view that no fruitful purpose will be served keeping the writ petition pending as a direction is being issued to the respondent no.4 to consider the claim of the petitioner with regard to issuance of Form-C and pass appropriate order, in accordance with law, within a month from the date a certified copy of this order alongwith fresh representation.
With the aforesaid observation, the writ petition is finally
disposed of.
