The abovesaid First Appeals have been filed by the appellantsState being aggrieved and dissatisfied with the judgment and award passed by the Learned 4th Additional Senior Civil Judge, Bharuch in Land Reference Case Nos.272 & 273 of 2007 on the grounds stated in the memo of Appeals. Heard learned APG Mr.P.P. Banaji for the appellantsState and learned counsel, Mr.K.M. Sheth for the respondentsoriginal claimants.
As it transpires from the records, for the same Village : Muler, First Appeal Nos.2648 & 2649 of 2011 have been filed and have already been disposed of on merits by this Court vide order dated 29.12.2011. Over and above, claim involved in the matter is petty claim. In view of the above, without entering into the merits of the matter only on the smallness of the claim, the present First Appeals stand disposed of.
