Heard learned counsel for the petitioner, learned Standing Counsel for respondents State and Sri Sunil Kumar Singh, learned counsel appearing for the Gaon Sabha.
Pursuant to the order dated 19.07.2021, instructions have come, which are taken on record.
According to instructions, the land in dispute has been transferred by the Gaon Sabha for construction of Panchayat Bhawan by the resolution dated 28.12.2020.
The contention of learned counsel for the petitioner is that he has constructed a house over the said land and is residing for last 50 years. The instruction indicates that no such resolution of the Land Management Committee was passed in favour of petitioner on 25.09.2020 and 22.10.2020.
Learned counsel for the petitioner submitted that ventilating his grievance, petitioner had approached the District Magistrate on 24.02.2021 and the application made before the authority is pending consideration.
In view of said fact, order dated 28.12.2020 passed by respondent no. 2 needs no interference in view of the instructions so received, however, District Magistrate shall take decision on the application of the petitioner strictly in accordance with law within a period of two months, from the date of production of copy of this order downloaded from the official website of this Court.
Writ petition stands disposed of.
