Heard Mr. A.D. Shah, learned advocate for the applicant and Mr. N.S.Desai, learned advocate for respondent No.2 and Mr.N.J. Shah, learned APP for respondent No.1.
Mr.Shah and Mr.Desai, learned advocates for the petitioner and respondent No.2, have jointly submitted that the dispute is a private/personal dispute in nature. It is jointly submitted by the learned advocates that the settlement has been arrived at between the parties on 14.9.2012. Learned advocate for respondent No.2 has placed affidavit-in-reply on record of the application. It is submitted that in the affidavit, the deponent has accepted the factum about settlement and the parties have agreed to abide by the said settlement and that, therefore, the applicant and respondent No.2 and their respective advocates jointly request that the FIR may be quashed.
It is also submitted that the parties have agreed to put the settlement in effect, from 31.12.2012. In that view of the matter, the learned advocates for the applicant and respondent No.2 have jointly submitted for early final hearing of the application.
Having regard to the said joint submission and request and also considering the fact that the learned APP has no objection, below mentioned order is passed.
RULE, returnable on 28.12.2012.
Mr.Desai, learned advocate for respondent No.2 waives service of process and Mr.Shah, learned APP for respondent No.1 waives service of process.
