1. As such the matters are fully heard considering the order dated 26.12.2012. Mr. Desai, learned Counsel for respondent no.2 states that Petitions being Special Civil Applications No.1995 of 2011, 2011 of 2011, 2010 of 2011, 2016 of 2011 and 1993 of 2011 challenging the orders passed under section 41A as well as under section 68(e) of the Bombay Trust Act as well as the proceedings under Benami Transactions (Prohibition) Act, 1988 have already been withdrawn by respondent no.2 on the basis of the said settlement which is part of these petitions. Mr. Desai further states that in fact respondent no.2 has also withdrawn contempt petitions which were filed against some of the petitioners herein.
2. As recorded by this Court (Coram : K.M.Thaker,J) dated 26.12.2012 the dispute being private/personal in nature and considering the fact that the settlement is arrived at between petitioner nos. 1 to 3 however, as respondent no.2 is not personally present today, the learned Advocates appearing on behalf of the respective parties seek permission to move the learned Vacation Judge. It would be open for the learned Counsels to move the learned Vacation Judge, in view of the fact that the settlement is arrived at. Permission to move the learned Vacation Judge is subject to convenience of the learned Vacation Judge.
