JUDGMENT / ORDER

Heard learned advocates for the private parties and learned APP.
Considering the prayers and undertaking dated 15.02.2012 filed by the petitioner stating that in case if the petitioner obtains passport from the Passport Authority, the petitioner shall not utilize the same without prior permission of the court concerned and he shall surrender original passport with the Trial Court, I am inclined to direct the trial Court to grant No Objection Certificate to apply for obtaining passport by the petitioner. In case of necessity, in addition to the above undertaking, it will be open for the learned 3rd Additional Sessions Judge, Jamnagar to impose suitable conditions.
It is made clear that if the petitioner is required in any other offence, action can only be taken in accordance with law and that shall not come in the way of the petitioner in getting the passport in accordance with law.
Accordingly, this petition is allowed to the aforesaid extent only.
Direct service is permitted.
