Hasmat Ali vs Azmat Ali And Another

High Court Of Judicature at Allahabad|27 March, 2018

JUDGMENT / ORDER

Court No. - 19
Case :- MATTERS UNDER ARTICLE 227 No. - 1840 of 2018 Petitioner :- Hasmat Ali (Minor) Respondent :- Azmat Ali And Another Counsel for Petitioner :- Manoj Kumar
Hon'ble Manoj Kumar Gupta,J.
The only prayer made in the instant petition is for issuing a direction to the trial Court to decide Original Suit No. 1156/2014, expeditiously, without granting unnecessary adjournments.
Counsel for the petitioner submitted that the defendants have due knowledge of the pendency of the proceedings, but they have not entered appearance so far.
In case the defendants have not entered appearance despite service, it is always open to the petitioner to request the trial Court to proceed ex-parte against them. It is needless to observe that the trial Court is required to proceed in the matter with a sense of expedition, without granting unnecessary adjournments.
The petition is disposed of with the aforesaid observations.
