High Court Of Gujarat|17 May, 2012

JUDGMENT / ORDER

[1] Present application is filed by the convict through jail seeking 45 days temporary bail so as to attend 'Shrimanth' of her daughter.
[2] On perusal of jail remarks, it was noticed that in the month of October, 2011, 10 days temporary bail was granted for the same purpose i.e. for attending 'Shrimanth'.
[3] Learned APP was asked to record statement of the convict and find out as to whose 'Shrimanth' is to take place. Learned APP has placed on record statement of the convict wherein it is clearly that earlier she was released for attending 'Shrimanth' of her elder daughter - Shaira and now 'Shrimanth' of her younger daughter - Afsana is to take place.
[4] Taking into consideration the fact that earlier when the convict was released on temporary bail, she reported in time and in fact in the first instance, she reported one day earlier and there is nothing adverse recorded in the jail remarks, the application is allowed. The convict is ordered to be released on temporary bail for a period of 15 days from the date of her release, on her executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) to the satisfaction of the jail authorities.
[5] The convict shall surrender to the jail authorities on expiry of the temporary bail period.
[6] Rule is made absolute to the aforesaid extent.
