Heard Shri Bhanu Prakash Verma, learned counsel for the petitioner and Shri Manish Goyal, learned Senior Advocate assisted by Shri Siddharth Singhal for Life Insurance Corporation of India through video conferencing.
Present writ petition is preferred by the petitioner seeking following principal reliefs:-
"i) pass a writ, order or direction in the nature of certiorari quashing the suspension order dated 17.12.2020 passed by the respondent no.3 against the petitioner.
ii) issue writ, order or direction in the nature of mandamus commanding and directing the respondent authorities to revoke suspension order of the petitioner dated 17.12.2020.
iii. issue writ, order or direction in the nature of mandamus commanding and directing the respondent authorities to pay month to month salary to the petitioner as and when the same falls due."
Shri Manish Goyal, learned Senior Advocate appearing for the respondents has vehemently opposed the writ petition and submitted that the petitioner is working as Cashier in the Life Insurance Corporation of India, Branch Office, Bulandshahr. By the impugned order dated 17.12.2020 he was placed under suspension on account of serious financial indiscipline under Regulation 36 of Life Insurance Corporation of India Staff Regulation, 1960. The petitioner has already preferred an appeal dated 26.3.2021 before the third respondent challenging the suspension order and the same is pending consideration. He submits that once the petitioner has already preferred the statutory appeal against the said order then no relief can be accorded in his favour.
Confronted with this situation, learned counsel for the petitioner prays that direction may be issued to the Appellate Authority to decide the appeal in question within six months.
In the facts and circumstances, no useful purpose would be served in keeping the writ petitioin pending consideration.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case and with the consent, this writ petition is disposed of finally with a direction to the Appellate Authority to decide petitioner's the appeal in question by a speaking order within a period of four months from the date of production of a copy of this order before him.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
