Heard Sri Navneet Lal Srivastava, counsel for the petitioner and learned Standing counsel.
By means of the present writ petition, the petitioner seeks a direction in the nature of mandamus commanding the respondent no.2 Assistant Collector/Tehsildar, Nautanwa, District- Maharajganj to conclude the proceedings of Case No. 00281/2019, Computer No. T201905470300281 filed under Section 67 of U.P. Revenue Code 2006 within a stipulated period of time.
It is contended by learned counsel for the petitioner that the proceedings against the Mohammad Iliyas,respondent no.3 was initiated by the petitioner under Section 67 of U.P. Revenue Code 2006 for illegal occupation or damage or misappropriation of gaon sabha land i.e. 'Rasta', which is recorded in the revenue record. The said proceedings was initiated by the petitioner in the year 2017 but the same has not been concluded. It is further contended by learned counsel for the petitioner that the respondent no.3 enjoining the benefit of his unauthorized occupant over the public property i.e. 'Rasta'.
In the facts and circumstances of the case, direction is issued upon respondent no.2 Assistant Collector/Tehsildar, Nautanwa, District- Maharajganj to conclude the proceedings of Case No. 00281/2019, Computer No. T201905470300281 filed under Section 67 of U.P. Revenue Code 2006. in accordance with law expeditiously, preferably within a period of nine months from the date of production of a certified copy/computerized copy of this order.
With the above direction, the writ petition stands finally disposed of. No order as to costs.
