Heard learned counsel for the petitioner, learned AGA for the respondents-State and perused the record.
This petition for writ is preferred to quash the first information report dated 03.12.2017 bearing Case Crime No. 683 of 2017 pertaining to the offence under Sections- 457, 376-D, 506 IPC and 3/4 POCSO Act pending investigation at Police Station- Thana Bhawan, District- Shamli.
The submission of learned counsel for the petitioner is that the instant matter is nothing but a counter to the first information report earlier lodged by the petitioner himself against the informants in first information report dated 03.12.2017.
We have looked into the contents of the first information report though this first information report, is little bit delayed but for that, specific reasons are given in the first information report itself. It is also pertinent to notice that the allegation levelled in the first information report are quite serious and those cannot be wiped out merely on the count that the earlier first information report was lodged at the instance of the petitioner.
In entirety, looking to the seriousness of the allegation, we do not find any just reason to quash the first information report as well as to stay the arrest of the petitioner.
The writ petition is dismissed.
