Heard learned counsel for the applicant and learned A.G.A. for the State.
The instant anticipatory bail application has been filed with a prayer to grant anticipatory bail to the applicant, Haseen, in Case Crime No. 45 of 2021, under Sections- 323, 504, 506, 494, 376 I.P.C., Police Station- Kotwali Ghaziabad, District- Ghaziabad.
Despite time granted, neither the learned counsel for the informant nor learned A.G.A. has filed any counter affidavit.
The applicant was implicated in this case on account of matrimonial dispute. The marriage of the couple took place in the year 2010. The applicant has been implicated by the daughter-in-law for the offence of rape. He is cousin of her father-in-law.
It has been submitted by learned counsel for the applicant that on account of misadjustment between the couple, the applicant has been falsely implicated only to pressurize the husband of the informant to fall in line.
The applicant has already been enlarged on interim anticipatory bail by this Court by order dated 23.02.2021.
The order is confirmed.
Applicant will remain on anticipatory bail till cognizance is taken by the court on the police report u/s 173 (2) Cr.P.C. on same terms and conditions as mentioned in the order dated 23.02.2021.
The anticipatory bail application is allowed to the aforementioned extent.
