Heard learned counsel for the petitioner.
By means of this petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"I) Issue the order directing respondent no. 1 Learned court below to decide the pending civil suit bearing number 870 of 2008 Hasan Isa @ Asad Versus Ram Asrey and other which is pending since 01.08.2008 expeditiously within the shortest time bound period in the interest of Justice."
Perusal of the ordersheet transpires that the suit is at the stage of evidence.
In such above view of the matter, this petition is disposed of with direction that the court below shall conclude the evidence of the petitioner-plaintiff within the six months, the evidence of the defendant shall be concluded within the next six months and the proceedings of the suit thereafter shall be concluded thereafter within next six months from the date of production of copy of this order.
It is clarified that time frame provided for disposal of the case shall be deemed to be extended in the event concerned District is hit by another surge of pandemic (SARS COV-2/COVID 19) resulting in the suspension of public movement and/or judicial work in the District concerned.
