Petitioner prays for time to deposit the license renewal fee for the excise year 2021-22. Upon written instructions received by Shri B.P. Singh Kachhawah, learned Standing Counsel states that the petitioner did not deposit the license fee within time extended by the State, up to 19.3.2021. Accordingly, vide order dated 22.3.2021, the license renewal application made by the petitioner has been cancelled.
Learned counsel for the petitioner disputes the correctness of the statement made by learned Standing Counsel and submits that the petitioner attempted to make a deposit on 19.3.2021 but the same could not be made due to server issue.
In view of the statement by learned Standing Counsel, whatever rights the petitioner may claim, may be contested in proper statutory proceedings as the disputed facts have apparently emerged, which may not be examined in the writ jurisdiction.
Accordingly, the present petition is dismissed, leaving it open to the petitioner to pursue his statutory remedy.
