JUDGMENT / ORDER

Rule.
Expedite.
By way of interim relief, the petitioner has prayed to restrain the respondents from taking further action under the Securitisation Act, 2002 qua plot no. 388, R S No. 437, village Padmala, Baroda, Gujarat. On a prima facie perusal by this Court, it appears that the petitioner has produced defective documents. Therefore, at this stage the contention of the petitioner regarding insufficient stamp fees cannot be considered as this Court is of the view that at this stage it shall not be appropriate for this Court to be a party to the alleged fraud or misrepresentation, if any. Hence interim relief is refused. However, the proceedings undertaken pursuant to the order of the Collector shall be subject to the final order of this Court.
