RULE.
Learned APP Ms. Krina Calla waives service of notice of Rule on behalf of the respondent State.
Heard learned Counsel appearing for the applicant and learned Additional Public Prosecutor Ms. Krina Calla for the respondent State.
Averments are made on oath in Paragraphs 5 and 6 of this application, about the necessity of the applicant to visit China for the purpose of business. In addition, documents are also annexed of the competent authority including the concerned Ministry about the conference to be attended. Besides, the applicant has abided with all the terms and conditions of the order dated 01.05.2013 passed in Criminal Miscellaneous Application No.6805/2013.
In the aforesaid circumstances, I deem it just and proper to :-
Modify condition no.(e) imposed vide the above order dated 01.05.2013;
The applicant is directed to submit an application for return of his passport to the concerned Court (where the Passport is deposited by the applicant) and the concerned Court shall decide the said application within a period of ONE WEEK, from the date of receipt of such an application;
The lower Court shall return the passport of the applicant, on furnishing a proper identification, for a period of six months, on depositing a sum of Rs.50,000/= (Rupees Fifty Thousand Only) and shall keep a photocopy of the passport thereof.
After the end of the period of six months, the applicant will redeposit his passport with the concerned Court.
It is also made clear that the other conditions of the order dated 01.05.2013 remain unaltered.
Order accordingly.
In view of the above, this application is allowed to the aforesaid extent. Rule made absolute. Direct Service is permitted.
