JUDGMENT / ORDER

Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents, Sri Kshitij Mishra, holding brief of Sri Sanjay Bhasin, learned counsel for Director General of Medical Education and Training, U.P. and Sri Ashish Kumar Pathak, holding brief of Sri Abhinav N. Trivedi, learned counsel for King George's Medical University, Lucknow.
The petitioner appeared in NEET Examination-2019 and on the basis of his merit in the said examination, he participated in first round of counselling and accordingly blocked one MBBS seat in Era's Lucknow Medical College, however on account of certain personal difficulties, as submitted by learned counsel for the petitioner, he did not take admission.
Prayer made in this petition is that Mop-up round of counselling on the remaining vacant seats is going to be held today and tomorrow and he may be allowed to participate in the said counselling.
The entire counselling schedule for the purpose of making admission to various undergraduate courses in medicine has been evolved in terms of the judgment of Hon'ble Supreme Court on 09.05.2017 rendered in the case of DAR-US-Slam Educational Trust and others vs. Medical Council of India and others, Writ Petition (Civil) No.267 of 2017, according to which only two round of counselling is permitted and thereafter Mop-up round of counselling is held, however, the candidates who opt/block seat in the first round of counselling but do not take admission are not permitted to participate in Mop-up round of counselling. Such stipulation has also been made in the schedule issued from the office of Director General of Medical Education and Training dated 16.08.2019, according to which only those candidates are eligible to Mop-up round of counselling who have not been allotted MBBS seat in the first and second round of counselling.
In view of the aforesaid clear stipulation, no interference in this petition is warranted by this Court. The petition is thus, dismissed.
