Heard learned counsel for the petitioner.
The present petition has been filed for a direction upon the Small Cause Court, Varanasi to expedite the Appeal No. 139 of 2016 (Harpreet Singh vs. Nagar Nigam and others) within a stipulated period.
The case of the petitioner is that his mutation application was rejected by the Zonal Officer, Nagar Nigam, Varanasi on 28.06.2016 against which he has preferred an appeal No. 139 of 2016 before Judge Small Cause Court, Varanasi and the same is being pending since last two years without any final decision. Several dates were fixed but the case was not decided. In support thereof, he has also annexed the order sheet.
Considering the facts of the case, the petition is disposed of with a direction to the Court below to decide the suit expeditiously, preferably if possible within a period of six months from the date of production of certified copy of the order without granting any unnecessary adjournments to either of the parties.
