Mr.B.T.Rao, learned counsel appearing for the petitioner, rightly points out that by an earlier order dated 26th September, 2011 this Court (Coram: Anant S. Dave, J) passed the following order:
"Notice returnable on 4.10.2011.
The respondents are directed to file reply with regard to action taken against the Medical Superintendent of the Hospital, in which, the petitioner was earlier serving. DS Permitted."
Thereafter, till date, neither explanation nor an affidavit has been filed as directed by this Court, as indicated above. S.O. to 02.02.2012. Affidavit-in-reply, in compliance to the earlier order, to be filed on or before 02.02.2012. If no such affidavit is filed, respondent No.2 is directed to remain personally present before this Court on 02.02.2012.
