Heard the counsel for the petitioner.
The present writ petition arises out of the orders passed in the proceedings registered under Section 34 of the Uttar Pradesh Land Revenue Act, 1901 (hereinafter referred to as, 'Act, 1901'). The proceedings under Section 34 of the Act, 1901 do not finally decide the title of the parties. The Board of Revenue as well as the trial court had rejected the Will produced by the petitioner on the ground that the execution of the Will was surrounded by suspicious circumstances inasmuch as through the said Will the deceased had not made any provision for his wife and the petitioner had not been able to dispel the suspicious circumstances surrounding the execution of the Will.
The petitioner has a remedy to institute appropriate proceeding for declaration of his rights in the disputed plot. There is no jurisdictional error in the orders passed by the revenue courts.
The writ petition lacks merit, and is, accordingly
dismissed.
