The petitioner has preferred this writ petition aggrieved by the order dated 22.12.2008 passed by respondent no. 3 (Annexure No. 5 to the writ petition )whereby his request for shifting the petitioner's retail diesel outlet has been rejected.
We have perused the material on record with the help of the respondent's counsel. It appears to us that the writ petition has become infructuous by afflux of time or the petitioner has lost his interest to pursue the matter.
Accordingly, the writ petition is dismissed.
We leave it open to the petitioner to move a recall application if the cause of action still survives or this order causes any prejudice to the rights of the petitioner.
