Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the entire proceedings of Criminal Misc. Case No. Nil of 2010 (State Vs. Harman) (relating to S.T. No. 29 of 2005), pending before the Sessions Judge, Jalaun at Orai in which the subject matter of Criminal Appeal No. 4980 of 2009 (Harman Vs. State of U.P.).
Learned counsel for the applicant submits that while the applicant had been convicted in S.T. No. 29 of 2005, he has been enlarged on bail in Criminal Appeal No. 4980 of 2009 (Harman Vs. State of U.P.) by this Court.
Perusal of the order sheet reveals that at present, it has been inquired by the learned Court below whether interim order passed by this Court in criminal appeal has been complied with by the applicant.
In view of the above, the present application is disposed of with the observation that subject to such confirmation received by the learned Court below, no coercive measure shall be taken against the applicant.
