1. Heard Mr.A.J. Patel, learned counsel for the petitioner.
2. Mr.Patel, learned counsel has produced on record the certified copy of application issued by and on behalf of the Collector, Vadodara.
3. It prima facie appears that the said application was received by the Collector and District Magistrate Office, Vadodara on 11.08.2008.
4. Hence, the Collector, Vadodara is hereby directed to file affidavit explaining as to why that application was not considered by him while passing the impugned order and why the statement is made in affidavit-in-reply dated 30.07.2012 that the said application was not in file when the order was passed at page 71 of the paper-book.
5. Such an affidavit shall be filed on or before 15.09.2012. S.O. to 17.09.2012.
