JUDGMENT / ORDER

Learned AGP appearing for respondent State has requested for time for taking instructions. Learned advocate for the petitioner has strongly objected to granting of time on account of various facts including the fact that bauxite, which is already extracted is lying as it is without further transporting thereof and bauxite is admittedly a mineral - major mineral, in which, the State has prima-facie greater role to have except regularizing its movement.
Learned AGP therefore granted time to take instructions and file affidavit-in-reply, if any, latest by 23.3.2012 with a copy to other side. In case, if affidavit-in-reply is not filed, it shall be presumed that as if averments made in the petition are to be accepted as they are not controverted and court may pass appropriate order including allowing the petition at this stage or granting interim relief as prayed for.
The matter be posted on 26.3.2012 so as to enable learned advocate for the petitioner to file rejoinder if any,. No further time shall be granted to any of the parties on account filing of any rejoinder or reply etc. and matter shall be proceeded with on 26.03.2012.
