Heard Sri Alok Kumar Mishra, learned counsel for the petitioner and Sri H.P. Srivastava learned Additional Chief Standing Counsel for the State.
Learned counsel for the opposite party at the very outset has raised a preliminary objection regarding the maintainability of the present writ petition on the ground that the petitioner as against the rejection of his application for issuance of the caste certificate, has a remedy of appeal under the Government Order dated 28.2.2011 and the position of law in this regard is also succinctly clarified by the Hon'ble Apex Court in the case of Kumari Madhuri Patil versus Additional Commissioner reported in (1994)6 SCC 241.
Once the petitioner has an alternative remedy open to him under law, we decline to entertain the writ petition on the ground of an alternative remedy. In case the appeal is filed by the petitioner, the same shall be dealt with by the Competent Authority, expeditiously in accordance with law.
The writ petition is, accordingly, disposed of.
