Heard learned counsel for the petitioner.
Present petition has been filed seeking a direction to the Civil Judge (J.D.) Gorakhpur to decide Original Suit No.m 473 of 2011, Harivansh Singh Vs. Tej Bahadur Singh and others for cancellation of Will dated 24.9.2007 executed by Smt. Batisa in favour of t he defendant no. 1 within a stipulated period.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the Civil Judge (J.D.) Gorakhpur to expedite the hearing of the aforesaid suit and decide the same on its own merit, in accordance with law, expeditiously provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present writ petition is finally disposed of.
