Heard Sri Praveen Kumar Singh, learned counsel for the petitioner, Sri N.K. Verma, learned AGA for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed with the prayer directing the respondent no.1 and 2 not to arrest the petitioners in case crime no.406 of 2018, u/s 354D, 506 IPC and 66A of I.T. Act, P.S. Cantt. District Varanasi.
Learned counsel for the petitioners submits that the petitioner who is a retired person is aged about 72 years and had given some money to the respondent no.3 which was demanded back by him for his needs but it was refused by the informant and present FIR has been lodged by the informant against the petitioner along with his daughter-in-law.
Learned A.G.A. opposed the prayer for quashing of the FIR.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
