Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents.
Present petition has been filed seeking direction to the respondent no. 3 to take appropriate action on the application of the petitioner dated 21.8.2018.
Submission of learned counsel for the petitioner is that the proceedings under Rule 115-C of U.P. Z.A. and L.R. Rules, 1952 have been finalized after dismissal of the appeal vide order dated 26.3.2018 filed by the private respondents under Section 67 (5) of the U.P. Revenue Code, 2006, however, till date no action has been taken.
Attention was also drawn to a letter dated 18.5.2018 written by the Tehsildar, Menhdawar to the Revenue Inspector in this regard.
In such view of the matter, present petition stands disposed of with a direction to the respondent no. 3-Assistant Collector/Tehsildar, Menhdawal, Sant Kabir Nagar to look into the matter and strictly comply with the orders of the Court regarding removal of encroachment preferably within a period of one month from the date of production of certified copy of this order, provided there is no other legal impediment.
