Heard learned counsel for the applicant and learned AGA for the State.
By means of the present application, the applicant has invoked the inherent jurisdiction of this Court to decide the protest petition dated 16.02.2016 in FRS No. 279 of 2015 arising out of case crime no. 1068 of 2013 under Sections 302 and 201 IPC, P.S. Kotwali Padrauna, District Kushinagar pending before the C.J.M., Padrauna, District Kushinagar.
Under the circumstances, it is directed that the learned CJM, Padrauna, Kushinagar would decide the protest petition of the applicant within a period of three months from the date of production of certified copy of this order by well reasoned and speaking order, if there is no legal impediment.
With the aforesaid observation, the application is disposed of finally.
