The petitioner who is the registered owner of a stage carriage bearing No.KL-6 D 9858, applied for temporary permit to operate on the route Kumali - Kottayam in place of stage carriage bearing No.KL-37 A 1915, by considering Ext.P2 application. 2. If vacancy of stage carriage bearing registration No.KL-37 A 1915 is still in existence and if no other person has applied for a temporary permit to operate a stage carriage in that vacancy, there will be a direction to the respondent to issue a temporary permit of four months duration within three weeks from the date of production of a copy of this judgment by passing appropriate orders on Ext.P2. Needless to say, such issuance of temporary permit will WP(C).27536/14 2 be subject to the preferential claim, if any.
Writ petition is disposed of as above.
