[1] This application is filed by the applicant under Section 438 of the Code of Criminal Procedure apprehending his arrest in connection with C.R.No.I-27 of 2011 registered with Dediyapada Police Station, District - Narmada for the offence punishable under Sections 406, 408, 420, 467, 468, 471, 381 of the Indian Penal Code.
[2] Heard learned advocates for the respective parties. It is alleged that present applicant was working as Field Officer. This Court has gone through the complaint more particularly para - 6 of the complaint. It appears that present applicant is involved in serious offence of misappropriation. Prima facie evidence is against present applicant. So far as other accused persons are concerned, charge sheet is filed. But as present applicant was absconding and as he did not remain present before the Investigating Officer, warrant under section 70 of Criminal Procedure Code is also issued.
[3] Considering above facts, present application is rejected. Rule discharged.
