1. Heard Sri Ajay Kumar Mishra, learned counsel for the petitioner as well as learned Standing Counsel for the State respondents.
2. Learned counsel for petitioner confines his relief to prayer No. 3 for a suitable direction to respondent No. 3 to decide the Case No. D201905440002341 (Harihar Vs. Indradev and others) Under Section 30 U.P. Revenue Code, 2006, within stipulated time period.
3. Learned counsel for the petitioner submits that grievance of the petition would be sufficiently met in case respondent no. 3- Additional District Magistrate (Finance / Revenue), District - Kushinagar. considers and decides the aforesaid case in the time bound manner.
4. Learned Standing Counsel has no objection to the aforesaid prayer.
5. Considering the facts and circumstances of the case, without entering into the merits,respondent no. 3- Additional District Magistrate (Finance / Revenue), District - Kushinagar. is directed to decide Case No. D201905440002341 (Harihar Vs. Indradev and others) Under Section 30 U.P. Revenue Code, 2006 expeditiously, say within a period of four months from the date of production of certified copy of this order, in accordance with law, if there is no legal impediment.
6. It is further directed that the parties to the case shall cooperate in expeditious disposal of the case and shall not seek any unnecessary adjournment, neither any such adjournment shall be granted by the Court concerned, except in exceptional circumstances.
7. With above observations/directions, the writ petition stands disposed of.
