Heard Shri G.D.Mishra, learned counsel for the petitioner and Shri Sabhapati Tiwari, learned counsel for respondent no. 2 as well as the standing counsel for respondent no.1.
The writ petition has been filed against the order dated 30.4.1992 passed by Deputy Director of Consolidation (respondent no.1) in Revision No.2831 and Revision No.1772 whereby respondent no.1 has allowed the restoration application filed by respondent no. 2 and has recalled his previous order dated 15.1.1992 after recording a finding that the recital in the order dated 15.1.1992 that the respondent no. 2 was heard appeared to be not correct as the alleged signatures of respondent no.2 on the order sheet of the revisional court did not correspond to any of his signatures on the records.
The counsel for the petitioner has not been able to show any perversity in the aforesaid findings of the Revisional Court which has been recorded after considering the relevant records in the case.
It is not a fit case for interference under Article 226 of the Constitution of India.
The Deputy Director of Consolidation, i.e. respondent no. 1 is directed to decide the Revision no.2831 and Revision No.1772 within a period of six months from the date a certified copy of this order is produced before him.
With the aforesaid direction, the writ petition is dismissed.
