JUDGMENT / ORDER

Learned standing counsel has accepted notice on behalf of respondent No. 2. Sri Harendra Prasad, Advocate, has entered appearance on behalf of respondent No.3.
Each one of the respondents is grnated six weeks' time to file counter affidavit. Rejoinder affidavit may be filed within next two weeks.
List thereafter.
It has been contended on behalf of the petitioner that at the respective booth there were total 104 voters, and at the time of counting 127 ballots were found, whereas only 75 votes were cast, out of which 20 were cast in favour of the petitioner. Petitioner submits that whatever manipulations were made, same were made at the behest of the election petitioner.
Argument advanced on behalf of the petitioner requires consideration by this Court. Since writ petition is being entertained and in the operative portion of the order, Election Tribunal has proceeded to declare casual vacancy, as such it is hereby directed that no fresh process of election would be undertaken during pendency of this writ petition.
