Bhatt, learned advocate for the petitioners seeks permission to withdraw this petition with a view to avail the liberty afforded to the petitioners by the very authority to exercise the discretion under Rule 18 for releasing vehicles on bond. The petitioners would approach the concerned authority within a week from today and their bond be considered in accordance with law. Learned AGP, on advance copy, submitted that there cannot be any objection to such a request. Hence, permission as sought for is granted. The matter is dismissed as withdrawn.
The Court not opined on merits of the matter the petitioner approaching the authority within a week from today with the bond and if the vehicles will not release by them, the same would be considered in accordance with law and especially under the provision of Rule 18 of the Gujarat Mineral (Prevention of illegal mining, transportation and storage) Rules, 2005.
