By order dated 10.05.2018, Petition Under Article 227 No.3348 of 2018 was disposed of but, it appears, by mistake, the order was entered under the heading "Writ-C No.3348 of 2018" though the same was pasted in the order sheet of Petition Under Article 227 No.3348 of 2018. The order dated 10.05.2018 is reproduced herein below:-
"Heard learned counsel for the petitioner.
The present petition has been filed for a direction upon the Court concerned to decide Execution Case No. 10 of 2007 within a stipulated period.
The order-sheet, which has been appended along with this petition is incomplete inasmuch as the last order is of 18.08.2017, fixing 15.09.2017.
As to what happened thereafter is not disclosed.
Under the circumstances, no specific direction need be issued, at this stage.
It is expected that if the proceedings are pending, the execution court shall bring the proceeding to its logical conclusion, in accordance with law.
With the aforesaid observations, the petition stands disposed of."
In view of the aforesaid mistake, the present correction application has been filed for correcting the particulars including parties name as well as counsel name appearing in the order.
As the aforesaid mistake has occurred due to incorrect feeding of Writ-C No.3348 of 2018 instead of Petition Under Article 227 No.3348 of 2018, the correction application is allowed.
The order dated 10.05.2018 passed in Writ-C No.3348 of 2018 quoted herein above would be deemed to have been passed on Petition Under Article 227 No.3348 of 2018. Necessary corrections be made in the records accordingly.
Let a copy of this order be also placed in the record of Writ-C No.3348 of 2018.
