The case of the petitioner is that respondent no.7, Basant Kumar Maurya is not having any kind of qualification to undertake surgery but he involved in surgical operations including medical termination of pregnancy. Before approaching this Court the petitioner submitted the representations to Chief Medical Officer, District Ballia as well as to the District Magistrate, Ballia. As per the learned counsel for the petitioner no action has been taken either by the Chief Medical Officer or by the District Magistrate, Ballia on the representation submitted.
Having considered all the facts and circumstances of the case, we dispose of this writ petition directing the District Magistrate, Ballia to get the entire matter enquired by the competent authority. If respondent no.7 is got having adequate qualification and licence to undertake surgery then appropriate action be taken against the petitioner. An inquiry to be made by the concerned Authority to inquire into the matter as against respondent no.7 against whom serious allegations are levelled by the petitioner within a period of six weeks from the date the petitioner presents a certified copy of this order before the District Magistrate alongwith the memo of writ petition.
This writ petition is, accordingly, disposed of.
