Heard Km. Vishwa Mohini, learned counsel for the petitioners and Sri Ashish Pathak, Advocate holding brief of Sri Abhinav N. Trivedi, learned counsel for the opposite parties.
Learned counsel for the petitioners has filed supplementary affidavit on 25.10.2018 in compliance of order dated 09.10.2018, wherein in para-4, it has been categorically indicated that identically placed persons have been getting regular salary etc. but the petitioners are being discriminated for no cogent reasons. In this supplementary affidavit, some dates with letter number has been indicated so as to corroborate the submission of the petitioners.
Since no reply to the aforesaid supplementary affidavit has been filed by the answering opposite parties, therefore, the presumption may be drawn that the contents of para-4 of the aforesaid supplementary affidavit are correct.
However, learned counsel for the opposite parties has disputed the aforesaid submission of learned counsel for the petitioners and prays two weeks' time to file reply of the aforesaid supplementary affidavit.
The time prayed for is granted to file reply to the supplementary affidavit dated 25.10.2018.
It is made clear that if no reply is filed by the answering opposite parties by the next date, it shall be presumed that the contents of para-4 of the said affidavit are true and any order can be passed.
List this petition in the week commencing 14.01.2019.
