Heard learned counsel for the petitioners and the learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to case crime no. 1386 of 2009, under Sections 452, 307, 323, 504 and 506 IPC, police station Ramkot, district Sitapur.
We have gone through the FIR impugned, FIR lodged by other side relating to case crime no. 1386-A of 2009, under Sections 452, 323, 504 and 506 IPC and injury reports of injured persons.
It being a cross case indicates that incident is admitted, but as to how it has been committed and as to which party was aggressor, is a matter of investigation.
Since the FIR discloses commission of cognizable offence, the same cannot be quashed.
The writ petition is misconceived and is accordingly dismissed.
