Heard learned counsel for the applicants and the learned A.G.A.
The case of the prosecution is that the accused applicants and the other accused committed dowry death of Smt. Sushma due to non-fulfillment of demand of dowry.
Learned counsel for the applicants pointed out that the applicants are brothers of the husband of the deceased. It was also pointed out that the father-in-law of the deceased has already been granted bail by this court on 21.4.2010 in Bail Application No. 8878 of 2010 .
I consider over the matter. The case of the accused applicants is at par with the case of the father-in-law and as such the applicants are also entitled for bail.
Let the accused-applicants Hari Shanker Bhagat and Pramod Bhagat be released on bail in case crime no. 600 of 2009, under sections 498-A, 304-B, 201 IPC and 3/4 D.P. Act, P.S. Taraiya Sujan, District Kushi Nagar on their executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the Court concerned.
