Heard learned counsel for the petitioners, learned Additional Government Advocate.
Under challenge in the instant writ petition is Case Crime No. 99A/2006 under Sections 147,148 and 304 I.P.C.,Police Station Akbarpur district Ambedkar Nagar.
We have gone through the contents of the F.I.R. and also contents of cross F.I.R. relating to case crime no. 99 of 2006 annexed as annexure no.1 to this petition.
It is a case that charge sheet has been filed in case crime no. 99 of 2006 and in crime no. 99-A of 2006 under Sections 147,148 and 304 I.P.C. final report has been submitted which was rejected on the protest of the complainant and it has been further prayed for quashing of F.I.R. of case crime no.99A of 2006 ..
Since the F.I.R. disclosess commission of cognizable offence, as such, the same can not be quashed.
The writ petition is misconceived and is accordingly dismissed.
However, it is provided that if the petitioners surrenders and move an application for bail, the same shall be considered and disposed of by the courts below expeditiously.
