Heard learned counsel for the petitioner, learned counsel for Gaon Sabha and the learned Standing Counsel.
Present petition has been filed beseeching early disposal of Case No. 1496 of 2021, Computerized No. T202102420501496 (Hari Prasad vs. Prema Devi) filed under Section 24 of the U.P. Revenue Code, 2006, pending before the Sub Divisional Magistrate, Chail, District Kaushambi (Respondent no. 2).
It is submitted that initially proceeding under Section 24 of the U.P. Revenue Code, 2006 was decided in favour of the petitioner vide order dated 19.03.2021. Contesting respondents have filed a recall application which was allowed by the order dated 29.06.2021. From the date of order of recall, aforesaid application under Section 24 of the U.P. Revenue Code, 2006, is pending disposal, despite the fact that statutory period for deciding the same, as enshrined under Section 24(3) of the U.P. Revenue Code, 2006 has already been elapsed.
Standing Counsel as well as counsel for Gaon Sabha have no objection, if a direction is issued to decide the aforesaid case, expeditiously.
In this conspectus as above, no useful purpose would be served to keep this matter pending. Therefore, this Court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case, as mentioned in the writ petition, with a direction to respondent no. 2 to decide the aforesaid case, strictly in accordance with law, by means of a reasoned and speaking order, after affording opportunity of hearing to the parties concerned and without granting any unnecessary adjournments to either of the parties expeditiously, preferably, within a period of three months from the date of production of certified copy of this order.
With the aforesaid direction, this petition is finally disposed of. Order Date :- 24.12.2021 VR/
