Heard Sri Ardhendu Shekhar Sharma, learned counsel for the petitioner, Sri Deepak Mishra, learned A.G.A. appearing for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer that suitable direction may be issued to the respondent authorities to transfer the investigation of Case Crime No.386 of 2018 under sections 147, 148, 149, 302 IPC and section 3(2)(v) SC/ST Act Police Station Alapur, District Budaun to the C.B.C.I.D. or some other independent agencies and arrest the accused persons i.e. the respondent nos. 5,6, 7, 8, 9 and 10.
Learned counsel for the petitioner submits that the petitioner is informant of the case. He lodged the present FIR but the police is not conducting fair investigation. He further submits that two persons were arrested during the course of investigation.
Learned A.G.A. is directed to seek instruction in the matter.
S.P. Budaun shall file personal affidavit by the next date fixed.
