By means of instant petition under Article 227 of the Constitution, the petitioner has challenged the order of District Judge passed under Section 24 C.P.C., refusing to transfer Civil Appeal No.101 of 2018 from the court of Additional District Judge/ Fast Track Court II, Hapur to some other court of competent jurisdiction.
The District Judge, after calling for comments from the Presiding Officer, has rejected the transfer application.
I have examined the grounds taken in the transfer application and I do not find it a fit case where the appeal should have been transferred. In such view of the matter, this Court declines to interfere with the impugned order.
The petition is accordingly dismissed.
