Heard Sri Surya Pratap Singh Parmar, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
The present application under Section 482 Cr.P.C. has been filed by the applicant with the prayer to direct the court below to expedite the proceedings of Sessions Trial No. 84 of 2020 (State vs. Hariom and others), arising out of Case Crime No. 280 of 2019, under Sections 147, 148, 149, 302, 34, 216 of IPC, Police Station- Colenganj, District- Allahabad, pending in the Court of Additional Sessions Judge, Court No.3, Allahabad, within a stipulated period.
It is contended by learned counsel for the applicant that the applicant is an accused in the aforesaid case crime in which after investigation congnizance was taken on the charge-sheet on 13.07.2019. He further submits that the charges have been framed on 13.09.2021. The trial is moving at a snail's pace on account of which the applicant is facing ignominy of protected trial since 2020.
In the peculiar facts and circumstances of the case, the trial court is directed to expedite the aforesaid trial and conclude the same as expeditiously as possible, strictly in accordance with law on day to day basis in consonance with the provisions of Section 309 Cr.P.C., without granting unnecessary adjournments to either of the parties, from the date of production of a certified copy of this order, if there is no legal impediment.
With the aforesaid observations, the present application under Section 482 Cr.P.C. is finally disposed of.
